Aggravated Burglary Acquittal
3 October 2024
Jason Cross and Sam Willis represented a brother and sister charged alongside their mother with aggravated burglary during which they were said to have intentionally inflicted grievous bodily harm on an aunt. The complainant and 2 neighbours alleged that the 3 defendants had forced their way into her home, and viciously attacked her to the head and body with a hammer, knife and broken glass. Following careful cross-examination, and deploying the product of targeted disclosure requests, the jury were shown medical records which significantly undermined the aunt's credibility and supported the defendants' accounts. After an eight-day trial all three defendants were acquitted and the prosecution's application for a non-conviction restraining order was refused in short order.
